1. About Us

2. Website Use

a. You must be at least 18 years old to make a purchase from our website.

b. You agree to provide accurate, current and complete information during the checkout process, including your delivery address and contact details. We are not responsible for failed deliveries caused by incorrect details.

c. You may not use our website for any unlawful or unauthorised purpose, or engage in any fraudulent activity.

d. You may not attempt to interfere with, disrupt or gain unauthorised access to our website, servers or any related systems.

3. Product Information and Pricing

a. We strive to provide accurate product descriptions, images, weights and pricing information. Images are for illustration and, because our chocolates are handmade, the product you receive may vary slightly in appearance.

b. All prices are listed in Sri Lankan Rupees (LKR) and are the final price for the product. Delivery charges are calculated separately at checkout and shown before you confirm your order.

c. Prices are subject to change without notice. A change in price does not affect an order already confirmed.

d. We do not guarantee that all website content is free from error. Where an obvious pricing or product error occurs, we may cancel the affected order and refund any amount paid.

4. Promotions and Discounts

a. Promotions, discount codes and offers are valid for a limited time and may be subject to their own terms, including minimum order values, product exclusions and expiry dates.

b. Unless stated otherwise, only one discount code may be used per order, and discount codes have no cash value and cannot be exchanged for cash or credit.

c. We may withdraw or amend any promotion at any time, and may cancel orders where a code has been used in a way not intended, including sharing of codes issued to a specific customer.

5. Orders and Payment

a. By placing an order on our website, you are making an offer to purchase the selected products. Your order is accepted only when we confirm it.

b. All orders are subject to availability and confirmation of payment.

c. We reserve the right to refuse or cancel any order at our discretion, including for reasons of product availability, errors in pricing or product information, incomplete delivery details, or suspected fraudulent activity.

d. We accept payment by card, cash on delivery, Koko and Mintpay.

e. Card payments are processed by PayHere, a third party payment provider. Your card details are handled by PayHere and we do not store or have access to your full payment details.

f. Where you pay using Koko or Mintpay, your payment arrangement is a separate agreement between you and that provider and is subject to their terms. Any dispute about instalments, fees or credit assessment must be raised with them directly.

g. You agree to provide valid and current payment information and authorise the charging of the total order amount, including delivery charges, to your chosen payment method.

6. Delivery

a. Orders are typically delivered within 4 to 5 days of order confirmation, shipped through our courier partners.

b. Delivery times are estimates. Actual delivery may vary depending on your location, courier performance, weather and other factors outside our control.

c. Delivery charges are shown at checkout before you confirm your order.

d. Risk in the products passes to you on delivery to the address provided at checkout.

7. Shelf Life, Storage and Allergens

a. Our chocolate bars have a shelf life of 10 months and our chocolate truffles have a shelf life of 5 months from the date of production, when stored correctly.

b. Please store all products in a cool, dry place away from direct sunlight and heat. We are not responsible for deterioration caused by storage after delivery.

c. Product and allergen information is provided on the product pages and on the packaging. If you have a food allergy or intolerance, please check this information before ordering and contact us if anything is unclear.

8. Refund Policy

a. Our Refund Policy governs the process and conditions for claims and refunds. Please refer to the Refund Policy on our website before placing an order.

b. In summary, because our chocolates are handmade to order and cannot be resold once they leave our care, we do not accept returns or offer refunds for change of mind, and orders cannot be cancelled once placed. Claims relating to incorrect or missing items must be made within 48 hours of delivery. Claims made after 48 hours are not eligible for a refund or replacement.

c. Where there is any inconsistency between these Terms and Conditions and the Refund Policy, the Refund Policy applies.

9. Intellectual Property

a. All content and materials on our website, including text, product descriptions, images, photography, logos, packaging designs and graphics, are protected by intellectual property rights and are the property of Nutsontop (Pvt) Ltd or its licensors.

b. You may not use, reproduce, distribute, republish or modify any content from our website without our prior written consent.

10. Privacy

Our Privacy Policy explains how we collect and use your personal information. Please refer to the Privacy Policy on our website.

11. Limitation of Liability

a. To the fullest extent permitted by law, Nutsontop (Pvt) Ltd, its directors, employees and affiliates shall not be liable for any indirect, incidental, special or consequential loss arising out of or in connection with your use of our website or the purchase and use of our products.

b. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the laws of Sri Lanka, including liability for death or personal injury caused by our negligence and liability arising under applicable consumer protection legislation.

c. Where our liability is not excluded, it is limited to the value of the order to which the claim relates.

12. Events Outside Our Control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including courier failure, extreme weather, power failure, strikes, civil unrest or government restrictions.

13. Changes to These Terms

We may modify, update or terminate these Terms and Conditions at any time without prior notice. The version in effect at the time of your order applies to that order. It is your responsibility to review these terms periodically for any changes. Continued use of our website constitutes acceptance of the revised terms.

14. Governing Law

These Terms and Conditions are governed by the laws of Sri Lanka, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of Sri Lanka.
